These Terms and Conditions ("Terms") govern your rental of a golf cart from Conch Cart Rentals Inc ("CCR," "we," "us," or "our"). By completing a booking or taking possession of a cart, you agree to be bound by these Terms. If you do not agree, do not proceed with your rental.

1. Renter Eligibility

• You must be at least 18 years of age with a valid government-issued ID to rent a golf cart.
• A valid driver's license is required to operate the cart on public roads.
• All passengers must comply with Key West municipal regulations regarding golf cart use.
• CCR reserves the right to refuse rental to any person at any time without explanation.

2. Booking & Payment

• Reservations made through FareHarbor are subject to FareHarbor's booking terms and payment processing.
• Full payment is required at the time of booking. Walk-up rentals are paid at pick-up.
• Pricing: 4-Passenger cart $180/day | 6-Passenger cart $260/day | 8-Passenger cart $300/day. Prices subject to change without notice.
• Conch Club member pricing (20% off) applies automatically for eligible returning guests. Cannot be combined with other discounts.

3. Cancellation & Refund Policy

• 72+ hours before rental: Full refund.
• 24–72 hours before rental: 50% refund.
• Less than 24 hours before rental: No refund, except in cases of documented emergency or mechanical failure on our part.
• No-shows: No refund. A 15-minute grace period applies at pick-up, after which the reservation is forfeited.
• Our service guarantee: If your cart experiences a mechanical issue, signal problem, or tech issue that significantly disrupts your rental, CCR will provide free ride credits, a replacement cart, or a full refund — at our discretion.

4. Cart Use & Prohibited Activities

The renter agrees to:

• Operate the cart only in areas lawfully permitted for golf cart use under Key West and Monroe County regulations.
• Obey all traffic laws, signals, and signs applicable to golf cart operation.
• Not operate the cart under the influence of alcohol, drugs, or any substance that impairs driving ability.
• Not permit anyone under 18 to operate the cart.
• Not exceed the cart's stated passenger capacity.
• Not use the cart off-road, on beaches, or on US-1 / Overseas Highway without explicit written permission.
• Not modify, alter, or tamper with any cart component including electronic systems.
• Return the cart clean and free of excessive damage (normal wear excepted).

5. Responsibility for Damage & Loss

The renter is financially responsible for:

• Any damage to the cart caused by negligence, misuse, or accident during the rental period.
• Theft of the cart or any of its components if it occurs due to the renter's failure to properly secure the cart using the provided locking mechanism.
• Traffic citations, parking violations, or fines incurred during the rental period.
• Towing fees if the cart is impounded due to illegal parking or operation.

CCR will document any damage at return. The renter agrees to pay assessed repair or replacement costs within 30 days of invoice.

6. Insurance & Liability

CCR's fleet carries commercial vehicle insurance. This coverage does not extend to the renter's personal liability or injuries.

• Renters assume all personal risk associated with golf cart operation.
• CCR is not liable for personal injury, death, or property damage to third parties arising from renter negligence or violation of these Terms.
• Renters are strongly encouraged to carry their own personal insurance coverage.

7. Mobile App & IoT System

• Cart unlock and ride control are managed via the Conch Cart Rentals mobile app using Bluetooth (BLE) technology.
• The renter is responsible for ensuring their smartphone is charged and Bluetooth-enabled for the duration of the rental.
• CCR is not liable for inability to operate the cart due to the renter's device failure, software issues unrelated to our platform, or operator error.
• Tampering with, disabling, or attempting to circumvent any electronic control system on the cart is strictly prohibited and will result in immediate termination of the rental without refund and potential criminal liability.

8. Return Policy

• Carts must be returned to the designated drop-off location at the time specified in your booking.
• Late returns will be charged at a pro-rated hourly rate of $30/hour or the full daily rate, whichever is less.

9. Force Majeure

CCR is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including extreme weather, natural disasters, government action, or infrastructure failures. In such events, we will offer rescheduling or credit where possible.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida. Any disputes arising from a rental shall be resolved in Monroe County, Florida. Both parties agree to attempt good-faith mediation before initiating formal legal proceedings.

11. Amendments
